Telework: Extension of the transitional period regarding social security affiliation for cross-border workers

The Administrative Commission for the Coordination of Social Security Systems of the European Union has updated its guidance note on telework to allow an extension of the transitional period for Member States.

During this transitional period, an administrative tolerance will be applied, allowing cross-border workers to continue to carry out work in the form of teleworking from their home, without having to worry about changing their social security affiliation if the 25% threshold provided for in the European legislation is exceeded.

On the basis of this guidance note, the transitional period is extended by 6 months and therefore runs until 30 June 2023.

The objective of this extension is to provide a stable framework for cross-border telework for the persons concerned while allowing the Administrative Commission to continue working on a sustainable European solution. Discussions with the neighbouring countries on a bilateral or multilateral agreement will also continue during this period.

This provision only applies to the social security field. Tax arrangements are regulated by separate specific bilateral agreements.
